NO PURCHASE IS NECESSARY TO ENTER OR WIN. Submitting an entry constitutes consumer’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which shall be final and binding on all matters relating to the Sweepstakes.

PROMOTION PERIOD: The Speakiesy #Unlock Campus Sweepstakes (hereafter, the “Sweepstakes”) begins at 12:00 am Eastern Time (“ET”) on October 2, 2015 and ends at 11:59 pm ET on December 4, 2015 (“Promotion Period”). The Sweepstakes will be divided into nine (9) weekly entry periods, as outlined in the chart below (each, a “Weekly Entry Period”).

ELIGIBILITY: Sweepstakes is open to all legal residents of fifty (50) United States, the District of Columbia and Canada (excluding residents of Puerto Rico and the province of Quebec) at least 18 years of age, who are enrolled as a full or part time undergraduate or graduate student at one of the Speakiesy participating schools listed at the bottom of these Official Rules as of October 2, 2015 (each, a “University”). Employees of MOKO Social Media, Inc. (“Sponsor”), Black Diamond Media, Inc. (“Administrator”), and their respective parents, subsidiaries, affiliates, promotion and advertising agencies and members of their immediate families (spouse, parents, siblings or children and their respective spouses, regardless of where they reside) and persons living in the same household of such employees, whether or not related, are not eligible to enter or win. Void in Puerto Rico, the province of Quebec and where prohibited by law. Sweepstakes is subject to all applicable federal, state and local laws.

HOW TO ENTER: There are two (2) ways to enter. During the Promotion Period, (1) SPEAKIESY APPLICATION: download the Speakiesy application on your smartphone and create a free Speakiesy account (if you have not done so already). Then, follow the instructions to post a photo, video or text content to your Speakiesy account and include the hashtags #unlockcampus and #scootersweeps to receive one (1) entry in the applicable Weekly Entry Period drawing. The content of your post will not be judged and will therefore not increase and decrease your chances of winning a prize. OR (2) MAIL-IN: to receive one (1) entry into the applicable Weekly Entry Period drawing without downloading the Speakiesy application on your smartphone or posting content, send a 3″ x 5″ piece of paper, hand-printed with your name, address, city, state, zip or postal code, date of birth, email address, daytime phone number (including area code) and the name of the participating University you attend, with proper postage, to: Speakiesy #Unlock Campus Sweepstakes, 201 King Street, Ste. 200, Alexandria, VA 22314.

Speakiesy application entries must be received by the dates specified in the chart above to be eligible for the applicable Weekly Entry Period drawing. Mail-in entries must be postmarked and received by the dates specified in the chart above to be eligible for the applicable Weekly Entry Period drawing. Only one (1) entry per participant using only one (1) email address permitted, regardless of method of entry. All entries become the property of the Sponsor and will not be acknowledged or returned. Entries generated by script, macro or other automated means or by any other means which subvert the entry process are void. Entries received from any person or email address in excess of the above stated limitation will be void. If a participating University un-affiliates during the Promotion Period, all entries received from the un-affiliated University will be null and void.

SPEAKIESY APPLICATION POST REQUIREMENTS: Posts may not contain, as determined by the Sponsor, in its sole discretion, any content that:

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group; appears to duplicate any other submitted Entries;
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
  • violates any law.

Posts must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. If the post contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties, the entrant is responsible for obtaining, prior to submission of the post, any and all releases and consents necessary to permit the use and exhibition of the post by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the post. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render post null and void. By submitting a post, entrant warrants and represents that he/she and any persons appearing or who are identifiable in the post consent to the submission and use of the post in the Sweepstakes and to its use as otherwise set forth herein.

PRIZES (9) (One (1) awarded per Weekly Entry Period): A self-balancing electric scooter. Approximate retail value of prize (“ARV”) of each weekly prize is $350 USD. Exact make and model of scooter to be determined by Sponsor in its sole discretion. Prize is non-transferable and no substitution is allowed except by Sponsor who reserves the right to substitute a prize with a prize of comparable or greater value if a prize is unavailable. Any costs or expenses incurred by the winners in claiming or using their prizes, including all federal, state, local, provincial and withholding taxes (if any), will be the responsibility of the winners. All prizes must be accepted as awarded and are not transferable or convertible to cash. No substitution for any prize or any element thereof will occur except in the Sponsor’s sole discretion. Return of prize or prize notification as undeliverable, or non-compliance with these Official Rules may result in disqualification and an alternate winner may be selected for the applicable prize. Certain additional restrictions may apply. Winners agree to be bound by these Official Rules and the decisions of the Administrator. Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Total ARV of all prizes: $3,150 USD.

RANDOM DRAWINGS: A random drawing will be conducted for each Weekly Entry Period on or about the dates specified in the chart above to select one (1) potential weekly prize winner from among all eligible entries received for each applicable drawing (for a total of nine (9) potential weekly winners). The odds of being selected as a weekly prize winner depend on the number of eligible entries received for each Weekly Entry Period. Non-winning entries from one Weekly Entry Period will not carry over into subsequent Weekly Entry Periods. Limit one (1) weekly prize per person and per household. Drawings will be conducted by Administrator, an independent judging organization whose decisions are final on all matters relating to this Sweepstakes.

WINNER NOTIFICATION: Potential winners will be notified via email. If a potential winner is an eligible Canadian resident, he/she will be required to correctly answer without assistance of any kind, whether mechanical or otherwise, a time limited mathematical skill testing question which will be administered by Sponsor by telephone at a mutually agreeable time. If a potential prize winner does not reply to the email within seven (7) days and provide all information requested by Sponsor, or skill testing question is not correctly answered (if an eligible Canadian resident), an alternate potential winner may be selected for the applicable prize. Potential weekly prize winners will be required to execute and return an affidavit of eligibility (or declaration of eligibility if an eligible Canadian resident), a liability release and where lawful a publicity release. All potential winners will be required to provide their complete address and phone number in order for prize to be awarded. If such documents are not returned within the specified time period, Administrator is unable to contact potential winner within a reasonable time period or potential winner is not in compliance with these Official Rules, he/she will be disqualified and an alternate winner may be selected at Administrator’s sole discretion.

GENERAL RULES: In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Officers, directors and employees of Sponsor, Administrator, participating University and each of their respective parents, subsidiaries, promotion agencies and agents (all such individuals and entities collectively referred to herein as, the “Promotion Entities”) are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with the Sweepstakes or by any human error which may occur in the processing of the entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Sweepstakes. In the event of a dispute as to any entry, the authorized account holder of the email account used to enter will be deemed to be the participant. Winners may be required to show proof of being the authorized account holder of the email account associated with the entry. Sponsor is not responsible for the failure of any entry to be received by Sponsor on account of technical problems or congestion on the internet or at any website. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek any and all remedies available from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, then the Sponsor reserves the right at its sole discretion to cancel the Sweepstakes and determine the potential winners in a random drawing from among all non-suspect, eligible entries prior to cancellation. By participating in the Sweepstakes, the participant agrees that the Promotion Entities will have no liability whatsoever for, and will be held harmless by participant for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from entry creation, the acceptance, possession, use or misuse of any prize or participation in the Sweepstakes or participation in any Sweepstakes-related activity. Acceptance of a prize constitutes permission for the Promotion Entities to use a winner’s name and/or likeness for purposes of advertising and trade without further compensation, including a winners list, unless prohibited by law.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Virginia, USA.

WINNER’S NAMES: For the names of the winners, available after December 31, 2015, send a self-addressed stamped envelope to: Speakiesy #Unlock Campus Sweepstakes List of Winners Request, 201 King Street, Ste. 200, Alexandria, VA 22314. Winner’s list requests must be received no later than February 1, 2016.
